1. Who We Are

Factory Hollow Apothecary ("we," "us," "our") is a sole proprietorship operated by Mari Schwartzer based in Amherst, Massachusetts, United States.

These Terms and Conditions govern all purchases made through www.factory-hollow.com (the "Site"). By placing an order, you agree to these Terms.

2. Products

We sell handmade cold-process soap and place-based art prints. Because our soaps are handcrafted in small batches:

  • Colors, swirl patterns, scent strength, and exact weight may vary slightly bar to bar, even within the same product listing. This is a natural feature of handmade goods, not a defect.

  • Product photos are as accurate as we can make them, but screen display settings may cause minor color variation.

  • Ingredient lists are provided on each product page or bar label. Please review them carefully if you have allergies or sensitivities. Feel free to email us to clarify ingredient questions before ordering.

3. Orders and Contract Formation

  • Placing an order is an offer to buy; a contract is formed only once we confirm and accept your order (e.g., by sending a confirmation email or shipping notice).

  • We reserve the right to refuse or cancel an order (for example, if an item is out of stock, mispriced, or we suspect fraud), in which case we'll notify you and refund any payment taken.

  • All prices are listed in US dollars and, unless stated otherwise, do not include shipping, customs duties, or import taxes, which are the buyer's responsibility for international orders.

4. Payment

  • Payment is due in full at the time of order.

  • We accept payments through Square (which currently accepts all major credit cards, Apple Pay, Google Pay, etc.). See Square’s website for updated details on their terms of service.

5. Shipping and Delivery

  • We process orders and ship as quickly as possible. As a small business, this can vary due to capacity and order volume, but we aim for it to never be more than 2-3 business days. Feel free to email us to inquire about your order.

  • Risk of loss and title for products pass to you upon delivery to the carrier, unless required otherwise by mandatory consumer law in your jurisdiction.

  • We are not responsible for delays caused by the carrier or customs once a package has left our hands, though we'll help however we can if something goes wrong.

  • We currently only ship within the United States and Canada, though we hope to expand soon. Email us to request an expansion to your home country, and we’ll see what we can do.

6. Returns, Refunds, and Faulty Goods

If an item arrives damaged, defective, or not as described, contact us at factoryhollow@pm.me within 7 days of receipt with photos, and we'll offer a replacement, repair, or refund.

7. Intellectual Property

All artwork, product photography, brand names, and site content are the property of Factory Hollow Apothecary unless otherwise credited, and may not be reproduced or used commercially without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Factory Hollow Apothecary is not liable for indirect, incidental, or consequential damages arising from use of our products or Site. Nothing in these Terms limits liability that cannot legally be excluded.

9. Privacy and Data Protection

We collect and process personal data (such as your name, shipping address, and email) to fulfill orders and, where you've agreed, to send marketing communications. Details of what we collect, why, and your rights are set out in our separate Privacy Policy at www.factory-hollow.com/privacy-policy, which is incorporated into these Terms by reference.

10. Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, without prejudice to any mandatory consumer-protection rights you have under the law of your own country of residence if you are a consumer.

11. Changes to These Terms

We may update these Terms from time to time; the version in effect at the time you place an order applies to that order. Material changes will be posted on this page with an updated "Last updated" date.
